Hereinafter referred to as “the Seller.”
These Terms and Conditions of Sale govern all purchases made through this website.
2. Scope
These Terms and Conditions apply to all orders placed on this website by individuals acting as consumers and who are legally capable of entering into a contract.
Placing an order constitutes full and unconditional acceptance of these Terms and Conditions.
The applicable Terms and Conditions are those in force on the date the order is confirmed.
3. Products
The products offered for sale are handcrafted soft pastels made in France.
Due to their artisanal manufacturing process, slight variations in colour, texture, dimensions or weight may occur. Such variations are a natural characteristic of handcrafted products and do not constitute defects.
Product photographs and illustrations are provided for guidance only and are not contractually binding. Colours may vary depending on individual screen settings.
Products should not be left within reach of young children without adult supervision.
4. Prices
All prices are displayed in euros (€).
VAT not applicable pursuant to Article 293 B of the French General Tax Code.
Delivery charges are displayed before the order is confirmed.
For deliveries outside the European Union, customs duties, import taxes or other local charges may apply. These remain the sole responsibility of the Customer.
The Seller reserves the right to modify prices at any time. Products will be invoiced at the prices applicable at the time the order is placed.
5. Orders
The Customer confirms that they are legally capable of entering into a binding contract.
An order becomes final once payment has been successfully processed.
An order confirmation email will then be sent to the Customer.
The Seller reserves the right to refuse or cancel any order in the event of:
- Payment failure
- A previous dispute with the Customer
- Exceptional stock shortages
- Fraudulent, abusive or unusual use of the website
6. Payment
Payment is due immediately upon placing the order.
Payments are processed securely through Stripe.
Accepted payment methods include major credit and debit cards, including Visa, Mastercard and American Express.
The Seller does not store any banking or payment card details.
7. Delivery
Orders are generally dispatched within 72 business hours, unless otherwise specified.
Estimated delivery times are:
- France: 2 to 5 business days
- Europe: approximately 5 to 10 business days
- International destinations: delivery times vary depending on the destination
These delivery times are estimates only and depend on the shipping carrier.
La Pastellerie cannot be held responsible for delays attributable to the carrier.
If an order arrives damaged or appears to have been lost during transit, the Customer must contact the Seller within three (3) days of receiving the parcel.
For deliveries outside the European Union, customs duties and local taxes may be payable upon receipt of the shipment. These charges remain the responsibility of the Customer.
8. Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, Customers have the right to withdraw from their purchase within 14 days of receiving their order.

Returned products must be:
- Unused
- In their original packaging
- In perfect condition
Return shipping costs are the responsibility of the Customer.
Refunds will be issued within a maximum of 14 days following receipt and inspection of the returned products.
9. Statutory Warranties
Customers benefit from:
- The statutory guarantee of conformity under Articles L217-3 et seq. of the French Consumer Code.
- The warranty against hidden defects under Articles 1641 et seq. of the French Civil Code.
Customers have two years to make a claim under the statutory guarantee of conformity.
10. Liability
The Seller shall not be liable for:
- Improper or inappropriate use of the products
- Damage occurring during transport
- Failure to comply with the laws or regulations of a foreign country
In all circumstances, the Seller’s liability shall be limited to the total amount paid for the relevant order.
11. Force majeure
The Seller shall not be held liable for any failure or delay in performing its obligations where such failure results from an event of force majeure as defined by Article 1218 of the French Civil Code.
12. Personal Data
Personal data is collected solely for the purpose of processing orders.
In accordance with the General Data Protection Regulation (GDPR), Customers have the right to:
- Access their personal data
- Rectify inaccurate information
- Object to certain processing activities
- Request deletion of their personal data

13. Intellectual Property
All content available on this website, including texts, photographs, graphics, designs, logos and other materials, is protected by intellectual property law.
Any reproduction, distribution or use without prior written authorisation is strictly prohibited.

In accordance with Article L612-1 of the French Consumer Code, Customers may refer any unresolved dispute to an independent consumer mediator free of charge.

15. Governing Law
These Terms and Conditions are governed by the laws of France.
Any dispute arising from these Terms and Conditions shall fall within the jurisdiction of the competent French courts.
